Welcome to Scirian (“Platform,” “Service,” “we,” “us,” or “our”). This Privacy Policy (“Agreement”) governs your access to and use of our AI-powered learning platform, including all features, content, and services offered through our website, mobile applications, and voice-enabled tutoring systems.

By accessing, registering, or using Scirian in any form, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of these terms, you may not use the Service. Your continued use of Scirian constitutes acceptance of any updates to this Agreement.

2. Definitions

• “User,” “you,” or “your” means any individual or entity accessing Scirian.
• “Personal Data” means any information relating to an identified or identifiable natural person.
• “Sensitive Personal Data” includes health data, biometric data, learning disability information, and academic performance records.
• “Processing” means any operation performed on data (collection, storage, analysis, transmission, deletion).

3. Information We Collect

Account Information

Name, email address, phone number, date of birth, educational level, learning goals, payment information, and account preferences.

Learning Data

Lesson progress, quiz responses, test scores, time spent on content, learning preferences, voice recordings from tutoring sessions, PDF uploads for analysis, and adaptive learning metrics.

Health & Accessibility Information

If you use Scirian for medical exam preparation (NEET, USMLE, etc.), we process health-related learning content and your performance on medical topics. If you disclose dyslexia, ADHD, or other learning needs, we process this data to customize your experience.

Voice & Biometric Data

Audio recordings of your voice during voice-AI tutoring sessions. These are used to power speech-to-text, language processing, and personalized voice responses. We process voice data via third-party STT providers (currently Whisper-compatible APIs).

Technical Data

IP address, device type, browser type, operating system, cookies, session IDs, device identifiers, and analytics data.

Communication Data

Messages sent via in-app chat, support tickets, feedback, and customer service interactions.

4. Legal Basis for Processing

We process your Personal Data based on:

• Contract: Necessary to provide the Service and fulfill your subscription agreement.
• Consent: Explicit consent for processing health data, voice recordings, and learning disability information.
• Legitimate Interests: Analytics, fraud prevention, platform improvement, and security.
• Legal Obligation: Compliance with tax, financial, and data protection regulations.

5. How We Use Your Data

• Deliver the AI tutoring service, adapt content to your learning style, and track progress
• Process payments and manage your subscription
• Personalize learning recommendations via spaced repetition and adaptive algorithms
• Improve the AI model through anonymized aggregation of learning outcomes
• Send educational content, updates, and service notifications
• Provide customer support and resolve technical issues
• Detect fraud, prevent abuse, and maintain platform security

6. Data Sharing and Third Parties

We do not sell your Personal Data. We share data only with:

Service Providers

Cloud infrastructure (AWS), payment processors (Paytm, Stripe), voice/STT providers (Whisper-compatible APIs), text-to-speech services (ElevenLabs), LLM providers (DeepSeek), and analytics platforms (Google Analytics). All processors sign Data Processing Agreements.

AI Marketplace Partners

If you enroll with specific AI tutors on our marketplace, we share your learning profile and progress data only with those tutors, with your explicit consent.

Legal Compliance

Law enforcement, regulators, or court orders in applicable jurisdictions.

Business Transfers

Merger, acquisition, or bankruptcy. Users will receive notice and the opportunity to opt-out if data practices change materially.

7. International Data Transfers

Scirian operates globally. Your data may be transferred to, stored in, and processed in countries other than your country of residence, including countries that may not have data protection laws equivalent to those in your home country. By using Scirian, you consent to such transfers. We implement safeguards including Standard Contractual Clauses and adequacy decisions where applicable.

8. Data Retention

• Active Account Data: Retained for the duration of your subscription and 30 days after cancellation, allowing account reactivation.
• Learning Analytics: Retained for 2 years for performance analysis, improvement, and regulatory compliance.
• Voice Recordings: Retained for 90 days after creation unless you request deletion. Aggregated voice models used for AI improvement are retained indefinitely unless you withdraw consent.
• Backup Data: Retained for 30 days on secure servers to enable account recovery.
• Payment Records: Retained for 7 years to comply with financial regulations.

9. Your Rights

Depending on your jurisdiction (GDPR, CCPA, PDPA, etc.), you have rights including:

• Access: Request a copy of all Personal Data we hold about you.
• Correction: Request amendment of inaccurate data.
• Deletion (Right to be Forgotten): Request erasure of your data, subject to legal obligations.
• Portability: Receive your data in a structured, portable format.
• Restriction: Limit processing of your data.
• Objection: Opt-out of marketing, analytics, or consent-based processing.
• Automated Decision-Making: Request human review of decisions made solely by algorithms.

10. Security Measures

• Multi-factor authentication for account protection.

No security is 100% secure. We notify users of data breaches within 72 hours where legally required.

11. Cookies and Tracking

We use cookies and similar tracking technologies for:

• Session Management: Keeping you logged in.
• Preferences: Remembering your settings and language choice.
• Analytics: Understanding user behavior and platform usage (non-identifiable).
• Advertising: Serving personalized ads across third-party platforms (only with consent).

12. Special Addendum: Students Under 16 (COPPA Compliance)

If you are under 16, a parent or legal guardian must:

1. Review this entire agreement
2. Provide verifiable consent (email confirmation)
3. Receive notice before any data sharing
4. Have the right to review or delete their child's data

We do not knowingly market to children or show targeted ads to users under 13.

13. Special Addendum: Indian Users (India Data Protection Framework)

Under India's data protection laws:

• Your data is processed lawfully with explicit consent
• You have rights to access, correction, and erasure
• Data Processing Agreements are in place with all third parties
• Cross-border transfers comply with government directives

Data Localization: We store backup copies in India-based data centers per regulatory requirements.

If you are using Scirian to prepare for medical exams (NEET, USMLE, etc.):

• Medical data you upload is treated as Sensitive Personal Data
• We do not use your data for diagnosis or treatment
• Voice recordings may contain medical discussions — they are encrypted and secured
• You should not share actual patient information or confidential medical records
• For actual medical advice, consult licensed healthcare professionals

17. Data Processing Addendum

Data Processors and Sub-Processors:

All processors have signed Data Processing Agreements (DPAs) and comply with applicable data protection regulations.
