Terms of Service

1. Eligibility and Account Registration

You must be at least 13 years old to use Scirian. If you are under 18, you warrant that your parent or guardian has reviewed and agreed to this Agreement. Users under 16 (or applicable age of digital consent in your jurisdiction) require verifiable parental consent.

You agree to provide accurate, complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account. You agree to notify us immediately of unauthorized access.

2. Subscription Plans and Billing

Scirian offers various subscription tiers (Free, Pro, Premium). Free accounts have limited access to voice tutoring minutes and advanced features. Paid plans auto-renew monthly or annually unless canceled.

All prices are in USD unless otherwise stated. Taxes and applicable fees are added at checkout. Payment is processed via Paytm, Stripe, or other designated processors. Failed payments may result in service suspension after 3 days' notice.

You may cancel anytime via account settings. Refunds are issued per our refund policy: within 14 days of purchase for unused services; after 14 days, no refunds are issued unless required by law.

3. Permitted Use

You agree to use Scirian only for lawful educational purposes. You will not:

• Violate any laws, regulations, or third-party rights.
• Upload malware, viruses, or harmful code.
• Attempt to gain unauthorized access to the platform or other users' accounts.
• Reverse-engineer, decompile, or circumvent security measures.
• Harass, threaten, defame, or spam other users.
• Use bots or automated tools without authorization.
• Scrape or extract data from the platform.
• Impersonate another person or entity.

Violating these terms may result in account suspension or termination without refund.

4. Content Ownership and Rights

Scirian Content

All course materials, lessons, quizzes, PDFs, tutoring content, AI models, and platform features are owned by Scirian or our licensors. You receive a limited, non-exclusive, non-transferable license to use this content for personal, non-commercial educational purposes.

User Content

You retain ownership of any documents, notes, or academic work you upload. By uploading, you grant Scirian a license to process, analyze, and store this content to provide the Service. We may use anonymized, aggregated insights from your work to improve our AI models, unless you opt-out.

You warrant that any User Content you upload does not infringe third-party intellectual property rights and complies with applicable laws. Scirian is not responsible for copyright infringement by users.

5. AI Tutor Marketplace

Scirian facilitates connections between learners and AI tutors. Independent tutors (“Marketplace Partners”) offer services through our platform. Each tutor has their own terms and policies. Scirian is not responsible for the quality, accuracy, or legality of tutor-provided content.

Disputes between users and tutors are governed by the individual tutor agreement. Scirian provides dispute resolution support but is not a party to tutor-user contracts.

6. Voice AI and Tutoring

Scirian's voice AI tutoring feature uses speech-to-text, language models, and text-to-speech technologies. Tutoring sessions are recorded and stored. By using voice tutoring, you consent to:

• Audio recording and processing of your voice.
• Analysis of your accent, pronunciation, and speaking patterns for learning improvement.
• Use of aggregated voice data to train and improve the AI tutor (anonymized).

You may opt-out of voice training data usage in account settings; this does not prevent tutoring but limits personalization.

You agree to indemnify, defend, and hold harmless Scirian and its officers, employees, and agents from any claims, damages, losses, and liabilities (including legal fees) arising from: (a) your use of the Service; (b) violation of this Agreement; (c) infringement of third-party rights by your User Content; or (d) your conduct or actions.

9. Intellectual Property Notices

All content, features, and functionality are the exclusive property of Scirian or its licensors. Unauthorized reproduction, distribution, or modification is prohibited. Respect for intellectual property rights is a condition of use.

10. Dispute Resolution and Arbitration

Any disputes arising from this Agreement shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes will be subject to binding arbitration under the rules of applicable arbitration bodies. Arbitration will be conducted in English and decided by a single arbitrator unless the claim exceeds USD 100,000.

Each party bears its own legal fees unless the arbitrator finds the claim frivolous.

11. Governing Law

This Agreement is governed by applicable law in your jurisdiction, without regard to conflicts of law principles. The UN Convention on Contracts for the International Sale of Goods is excluded.

12. Termination

You may terminate your account anytime by deleting it via account settings. Scirian may suspend or terminate your account for: (a) violation of this Agreement; (b) non-payment; (c) inactivity; or (d) security risk, with appropriate notice.

Upon termination, data will be retained per the retention schedule in Section 8 of the Privacy Policy, then permanently deleted. Survival: Sections 7–9 survive termination.

13. Modifications to Terms and Service

Scirian reserves the right to modify this Agreement at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after notification constitutes acceptance.

14. Severability

If any provision of this Agreement is found unenforceable, that provision shall be severed, and the remainder shall remain in effect.
